These are our terms and conditions for any orders placed with Mobii Systems (Pty) Ltd (herein after referred to as "MOBII") on the MOBII website.
Please read these purchasing terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which
MOBII makes these products available to you. If you do not accept these terms and conditions you may not purchase any products from MOBII. Any
Order arising from you on this website, indicates your express agreement to be bound by these terms and conditions.

All prices are inclusive of VAT. The price of products exclude any and all delivery charges.
Delivery options and charges will be calculated and included in the Quotation and/or Order Confirmation, which is emailed after an order form has been received via the MOBII website.
availability
Stock of all goods on offer are limited. MOBII shall take all reasonable efforts to ensure that when stock is no longer available, that offers thereof are discontinued.
Should items still be offered after stock is sold out and MOBII is unable to fulfill the orders placed at advertised prices, MOBII shall only be liable to refund the amount paid by you for such product orders.
acceptance and payment terms
When and order has been submitted via the MOBII website, we will acknowledge your enquiry via email, at which point a Tax Invoice will be issued to you along with a Reference number, our banking information, and payment terms.
All payments must be identified by supplying the Reference number and your surname in the reference section of the bank deposit slip or on the electronic transfer.
When ordered items are available for delivery, a Dispatch Notification Email will be sent confirming that the order is ready to be sent, at which time, full payment of the Tax Invoice must be made.
Orders will only be dispatched once full payment has been received and reflected in the bank account of MOBII.
If full payment has not been received within five (5) working days of the Dispatch Notification Email having been sent, then the order will be cancelled and a refund issued.
Completion of the Order form on the MOBII website does not constitute an agreement of sale and/or constitute an order for such product.
Please note that no cheques will be accepted.
delivery
Subject to availability and receipt of payment, delivery will be made to the address specified by you on the Order form submitted via the website.
Orders will only be dispatched once full payment has been received and reflected in the bank account of MOBII.
Pre-order products will be handled separately, and will be shipped when ready.
Once orders have been dispatched, a tracking number will be issued to you, so that you can track the progress of the delivery.
Please note that while we do our best to ensure that your delivery arrives on time, MOBII will not be held liable for any loss caused by delay in delivery arising out of any cause beyond our control.
Delivery to international destinations exclude duties and taxes which may be payable. It is your responsibility to determine (prior to order placement) and make payment for these additional charges when contacted by the delivery courier.
delivery charges
Our preferred courier is Dawn Wing. All packages will be sent via overnight courier to the address
specified in the order. Please note that overnight courier time is not guaranteed outside of metropolitan areas.
There will be NO delivery charge levied on any orders which include one of the Motion M01-1 Packages.
For all other ordered items, there is a flat rate charge of R65 for all domestic orders
sent via courier using the overnight option to the destination address supplied on the order form on the MOBII website.
This is valid for all orders with a combined weight of up to 2 Kgs. Kindly note,
we currently offer shipping in South Africa only. Please contact us for international shipping information.
cancellation
You have the right to cancel your order up to 7 days after date of receipt of the order delivery and to obtain a full purchase price refund within 30 days thereafter.
MOBII will only refund the price paid for the products (excluding delivery costs) if the products are returned to MOBII at your expense within 14 days of invoice and that any products have NOT been opened (this means that any seals and product shrink wrap must be kept intact).

returns
A 1 year warranty is offered on the Motion M01-1. Proof of purchase is required in order to return a Motion M01-1.
All Motion M01-1 products are thoroughly tested before leaving our factory. If any of our Motion M01-1 products are found to be faulty, you are requested to contact us.
If the problem is determined to be software or firmware related, we will engage with you and issue you with program update to rectify any issue.
If the fault is determined to be either of a manufacturing nature, or electronic hardware related, then we will arrange for the product to be collected by courier at no cost to the customer.
Please note that faults resulting from normal wear and tear, or product abuse, will not be able to be returned. Whilst we have designed a product for various sports environments, we want customers to understand that reasonable care must be taken, as with all other similar electronic products.
privacy
MOBII will take all reasonable steps to protect the personal information of it is customers.
We will not issue personally identifiable information to any third party, without your consent.
We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent, unless that use is part of a specific program or feature for which you will have the ability to opt-in or opt-out.
We may, however, use your email address without further consent for administrative purposes (such as notifying you of major MOBII website changes or for customer service purposes).
country of domicile
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any disputes will be decided only by South African courts.
If any of the above mentioned terms or conditions are held by a court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
variation of terms
MOBII may, in its sole discretion, change this agreement or any part thereof at any time without notice.
